4.4 Yoltia will communicate to you via email, within a maximum period of 15 (fifteen) business days (counted from the date on which it received the corresponding request duly integrated) the determination adopted, in order that if it is appropriate, the same becomes effective within 15 (fifteen) business days following the date on which the response is communicated to you, the above in accordance with the provisions of the Law, the aforementioned deadlines may be extended once for an equal period, provided that it is justified by the circumstances of the case. In case the information provided in your request is erroneous or insufficient, or if the corresponding supporting documents are not provided, we may request you, within 15 (fifteen) business days following the receipt of the request, to provide the necessary elements or documents to process it. You will have 10 (ten) business days to comply with the request, counted from the day after you have received it.
If no response is given within said period, the corresponding application shall be deemed not to have been filed.
4.5 Yoltia may deny access to Personal Data or to rectify or cancel or grant opposition to the Processing thereof when: (1) the applicant is not the Personal Data Owner or the legal representative is not duly accredited to do so; (2) in its database it does not find the applicant’s Personal Data; (3) the rights of a third party are injured; (4) there is a legal impediment or in its case there is a resolution of a competent authority that restricts access or prevents the rectification, cancellation or opposition of the same; and (5) the rectification, cancellation or opposition has already been carried out.
